Committee lowers fine and makes motorcycle-safety surcharge mandatory to restore fund revenue

Representative Luttrell described House Bill 1022 as a change to a prior law that had allowed judges discretion to add a fine intended to fund the motorcycle safety fund. Luttrell told the committee that judges rarely imposed the optional fine and that average annual revenue to the motorcycle safety fund under the prior law was about $31.
The bill would make the surcharge mandatory and cap the fine at $500. “So for the last 5 years, the income to the motorcycle safety fund has averaged $31 per year from that fine. This simply says that they shall fine someone. And we lowered the fine to $500 not to exceed $500 and the money still goes to the motorcycle safety fund,” Luttrell said.
There was no recorded substantive debate. The committee voted 4-0 to advance the bill to subcommittee.
