Committee introduces RS32361 to clarify school safety code on background checks and emergency planning

Representative Chris Mathias, sponsor of RS32361, told the House Committee on Education on Feb. 12 that the draft replaces existing language in a section of Idaho law that attempted to do three separate things in one paragraph and that the replacement disentangles those functions.
Mathias said the draft requires school districts to develop and maintain a safe environment for students by: (1) creating a system of background checks for all persons who have unsupervised contact with students, (2) requiring each school to create and maintain an emergency operations plan, and (3) requiring initial and annual emergency operations planning training for school district staff. He told the committee the prior draft’s separate provision shielding training and plans from public disclosure was unnecessary because Idaho Code 70-4-105(4)(b) already exempts records related to critical infrastructure — including emergency response plans — when disclosure is reasonably likely to jeopardize safety.
Committee members asked few substantive questions during the introduction. Representative Harris thanked Mathias for bringing the issue back to the committee. A motion was made to introduce RS32361 and send it to the second reading calendar with a due-pass recommendation. The committee approved the motion by voice vote; the chair announced the motion passed.
Mathias said he brought the replacement RS to correct confusing statutory language and to ensure the obligations on school districts are clear and individually stated.
No amendments were proposed during the committee introduction and no formal roll-call vote was recorded in the transcript; the committee resolved to advance the RS to second reading with a due-pass recommendation. The transcript records the statute cited by the sponsor as Idaho Code 70-4-105(4)(b) in support of not adding a separate public-records exemption.
Looking ahead, the RS will proceed to the legislative calendar for second reading, where it will receive additional committee or floor consideration.
