Joan summarized three central purposes of the law: to prohibit action at secret meetings, to ensure the public’s right to be informed, and to give the public an opportunity to present views on subjects the commission considers. She warned commissioners to avoid gatherings that amount to a quorum outside a public meeting and to avoid serial communications — including phone calls, emails, texts and social media — that could collectively amount to a decision outside a public meeting. For this commission, Joan said a quorum is three or more members.
Joan noted exceptions exist, chiefly for certain closed-session topics such as labor negotiations, but called those exceptions "few and far between." She also cautioned that a person who intentionally violates the law may be subject to civil penalty and that the penalty is assessed on the individual who committed the infraction, not the public body. Joan told commissioners to read the materials provided in their packet and to contact staff with further questions.
