Madison’s Board of Zoning Appeals granted a variance from lot-acreage requirements for 1166 East River Bluff Lake Drive on Feb. 10, allowing the homeowner to rebuild on the existing foundation after a fire.
Paul Kelly appeared on behalf of homeowner Mark Cheatham and explained the house and lot were created under older rules and many lots in the subdivision are smaller than current one-acre requirements. Attorney Joe Jenner and staff recounted a prior board decision in February 2021 for a similar address at 1360 Scenic View Drive and said the board had followed the same approach to resolve the subdivision’s legacy nonconformities.
Board members asked whether the rebuilt structure would conform to the prior footprint; staff and the applicant said the house would be rebuilt on the same foundation and that the variance is necessary to obtain a building permit. The board stated there was no evidence the rebuild would injure public health or adjacent values, and members found practical difficulties because the lots were platted under old standards.
The board approved application BZVD-25-3 by roll call. The approval authorizes the rebuild subject to normal permit reviews and does not change zoning for other lots in the subdivision.
