Magistrate extends status hearing for Seth Fishman case to May 13 amid criminal-case and contractor disputes

A Town of Highland Beach special magistrate extended the status hearing for case CC24-86 to May 13, 2025, after the owner's representative described complications including the owner's incarceration, contractor disputes, and a pending criminal appeal.

Adam Mosowski, the town's code compliance officer, said permits for the property were expired as of the morning of the hearing and that the town had stayed fines at a prior hearing and scheduled a status update. Robert Fishman, appearing with power of attorney for his son, Seth Fishman, said Seth was incarcerated and subject to a lockdown at the facility, that he had lost regular access to his son, and that contractor work had stopped after contractors were paid and then walked off the job. Robert Fishman offered a settlement agreement and said a contractor had placed funds into escrow as part of litigation.

Town staff said life-safety concerns had been addressed but that expired permits remained on the file. Because of the complexity, including representations that federal asset restraints and appeals proceedings were involved, the town recommended granting additional time. The magistrate scheduled a status hearing on May 13, 2025, and ordered the matter continued to that date.

The hearing record notes that the respondent remains represented by family with power of attorney and that the town and the respondent will continue to work toward resolution and permit reactivation or replacement before the May 13 status hearing.
