Highland Beach magistrate finds owner responsible for unpermitted bathroom remodels, grants 30 days to comply

A special magistrate for the Town of Highland Beach found that two bathroom remodels at 2727 South Ocean Boulevard, Unit 306, were performed without proper permits and ordered the respondent to come into compliance within 30 days or face fines.
The town's code compliance officer, Adam Mosowski, told the hearing the notice of violation alleged violations of 30-122(a) for “remodel and repair of 2 bathrooms without proper permits.” Mosowski said the notice was served by posting after certified mail, that a permit application was submitted on Feb. 3, 2025, and that the application is pending because a plumbing subpermit remains outstanding. He recommended the respondent be found in violation and assessed prosecution costs.
The town recommended 30 days to come into compliance or a fine of $250 per day thereafter, plus $250 in prosecution costs due within 30 days. Joshua Benrubi, an attorney with McDonald Hopkins representing the property owner, said the licensed contractor has submitted plans and was waiting on the licensed plumber and electrician to update registration with the town and that the parties were “expecting it to be within a week.”
After hearing from the town and the owner's representative, the special magistrate said he would grant 30 days and made findings that the violation exists as alleged. The magistrate set the compliance deadline as March 11, 2025, and assessed $250 in prosecution costs. The magistrate warned the owner that a daily fine of up to $250 may be imposed if compliance is not achieved by the deadline.
The magistrate’s order recorded service of the notice and the town’s evidence, including photographs and proof of service. The case record shows the town could not issue the remodel permit until the plumbing subpermit and contractor subregistrations were provided.
