The Board approved a variance of use and companion development‑standard variances for 421 South Union Street, allowing an existing legal nonconforming single‑family dwelling to be permitted in the MF‑1 (multifamily low density) district and authorizing two development‑standard exceptions.
Dane Crabtree of the Community Development Department told the board the request included: a variance of use to permit the existing single‑family dwelling in MF‑1; a variance to modify minimum lot width so the existing lot will comply; a building addition that would encroach 10 feet into a 20‑foot minimum side yard setback; and a replacement or new accessory building that would encroach about 17 feet into the same side yard, in the same location as an existing garage that already encroaches.
Staff noted a similar petition was considered in the same neighborhood in March 2024; no written public comments were received for this petition and the petitioner did not give a separate introductory presentation. The public hearing was opened and closed with no members of the public speaking. The board voted first to approve the variance of use (listed as 2502‑VU‑01) and then to approve the variance of standards (2502‑VS‑02). Both votes carried on roll call with all members present voting yes. The board also adopted findings of fact for each approval.
The approvals allow the property owner to retain and extend the existing footprint pattern while bringing the lot into compliance under the conditions specified in staff recommendations. Any building permits and inspections remain subject to regular review.
