Bill requiring turnpike authority notice and public comment advances after title struck; lawmakers seek clearer definitions

Senator Standridge presented Senate Bill 80, which would require the Oklahoma Turnpike Authority (OTA) to provide notice to affected property owners, offer a 30-day public comment period and then hold a public hearing for proposals to build new turnpikes or modify existing turnpikes. The bill also permits civil action if statutory notice and hearing requirements are not met.

"This bill will also guarantee stakeholders a 30 day public comment period followed by a public hearing with the authority," Senator Standridge said, adding the intent is to give property owners a chance to be heard. Committee members pressed for clearer definitions of "modification" and which property owners would be considered "affected." Senator Stewart and others asked whether routine maintenance would trigger notice; Standridge said the bill is intended to cover modifications that affect property or business operations and that he would work to clarify a radius or threshold so notices are meaningful.

Senator Pugh asked what remedy applies if notice requirements are not met; Standridge indicated the bill could be refined to specify an adjudicating authority and the committee struck the title by unanimous consent to allow revisions. "I believe that's something that could be added to the bill," Standridge said in response to questions about adjudication.

The committee advanced SB80 on a unanimous roll call; sponsor and members agreed to work on clearer language to define scope and remedies before further consideration.
