Council hears proposed right-of-way permitting code changes to address fiber buildout and restoration problems

City staff presented a package of proposed updates to Bloomington’s right-of-way permitting rules Monday aimed at improving permit review efficiency, strengthening restoration enforcement and reducing resident impacts during a multiyear fiber buildout.
Brian Hanson, the city’s development coordinator, told the council the recommendations were built from lessons learned during a surge of utility work in 2024—most notably fiber installation tied to federal infrastructure funding—and from staff reflection after managing a fourfold increase in permit activity compared with 2021.
Hanson said the administration is proposing multiple changes: switch to a base fee plus per-foot charge for underground permits (example proposed: $150 base up to 100 feet, then $0.40 per foot beyond that), a lower aerial permitting rate ($120 base up to 100 feet, then $0.20 per foot), and removal of a $36 separate processing fee. Staff also proposed allowing applicants to apply for larger service-area permits (to reduce duplicate plan review) while capping the amount of active permitted underground footage per applicant at 50,000 feet unless the city engineer authorizes more.
To reduce late-season and winter pavement problems, Hanson recommended adopting a formal winter moratorium, November 15 through April 15, unless authorized by the city engineer; the moratorium would allow soft-surface work but generally prohibit potholing and permanent patching when bituminous plants are closed.
Hanson said restoration was the single biggest source of resident complaints in 2024. Staff proposed clearer restoration standards tied to the city’s construction specifications, stricter inspection and final sign-off rules, and stronger enforcement tools — including requiring performance bonds and using existing bonding to fund city-conducted remediation when contractors fail to meet restoration obligations. Hanson said restoration sign-off would require permanent patching on hard surfaces and establishment of seed/sod on soft surfaces before a permit would be closed.
Hanson also described operational changes: requiring clearer vehicle and crew identification by contractors, door-hanger and notice requirements for residents, weekly coordination meetings with major providers, kickoff meetings for crews, and a GIS portal to provide a single source of utility and right-of-way mapping to improve plan quality.
Hanson told the council city staff issued roughly 1,500 right-of-way permits in 2024, with about 700 tied to fiber work; he said staff recorded just over 1,100,000 linear feet of underground conduit permitted and about 500,000 feet of aerial conduit permitted in 2024. Hanson estimated the average provider service area is about 45,000 linear feet and said a single drill crew can install roughly 1,500–2,000 feet per day under normal conditions.
Council members asked for additional cost-recovery detail. Council member Nelson asked staff to provide an estimate comparing the city’s staff cost for permitting and inspections to permit revenue; Hanson said staff would return before any formal action with a financial breakdown and noted the proposed fee structure could be adjusted to better match actual staff costs. Council member Moore voiced concern the changes could increase costs passed to customers of legacy utilities such as CenterPoint Energy and Xcel Energy; Hanson said staff will consult with the utilities and the fiber providers before returning with code language.
Hanson said the city plans to require compliance with an installer-certification program established by the state (a 40-hour certification for certain underground installation roles) if that program takes effect July 1, 2025, and he told the council staff will bring formal code amendments to the council in March for potential adoption before the 2025 construction season.
Hanson closed by pointing council members to a city webpage that collects reports from residents (blm.mn/fiber) and asking for feedback. No formal council action or ordinance vote was taken Monday; the item was a discussion and staff committed to returning with proposed code language and a financial analysis.
