Commissioners authorize legal to prepare sewer-easement paperwork to keep Karst Fields project on schedule

Justin Roddy of the county legal department told commissioners the Karst Fields project is delayed because a city sewer line that has been in place since the mid-1990s lacks a recorded easement. Roddy said permits and encroachment agreements the county needs are on hold until the city or utility (referred to as CBU in the meeting) signs the necessary encroachment or easement documents.
Roddy said the county has communicated with the city and the county's engineers (Bledsoe), but the city has declined to immediately sign off without documentation and assurances. Roddy described the immediate need as: "there's actually no easement over this pipe," and said the county is seeking preliminary approval to grant a permanent sewer easement so the city will process encroachment and permits.
Commissioners moved for county legal to draft a strongly worded letter to the city and to prepare a permanent sewer easement; they authorized the county executive (to sign the letter and, subject to county legal review, to execute the permanent sewer easement at the earliest possible moment) with the requirement that legal review occur and that the commission would ratify the easement at a public meeting. The motion passed by voice vote, 3-0.
Staff and commissioners said the easement matter is a paperwork issue dating to the original installation in 1995–1997 and warned the delay could push the construction schedule back; county staff noted certain contractors (lighting, synthetic turf installers) have limited scheduling windows. County counsel noted that if the easement has a value above $1,000 it may require additional county council approval under county rules.
Commissioners asked legal to expedite the paperwork and deliver it for signature either by DocuSign or by scanned signed copy, and the board instructed staff to coordinate with the mayor's office and city contacts to avoid further schedule impacts.
