Special Magistrate Don Win found several ongoing code violations at 1121 Second Avenue and ordered the estate of Emma B. Portlock to correct those violations by April 11, 2025.
City staff presented photographic evidence and inspection notes showing overgrown vegetation, debris and obstruction of sidewalks, boarded windows with no openable egress, and roof and drainage damage. Staff reported that the owner (the estate of Emma B. Portlock) had been mailed notices and that a notice of hearing was posted.
The magistrate found that required notices were provided in accordance with Chapter 163 of the Florida Statutes and city code, accepted the documentary evidence, and ordered corrective actions: remove debris from sidewalks, cut and maintain grass and weeds, remove blockages to provide openable windows, and repair or replace roof and soffits and obtain permits as required. The magistrate ordered the respondent to pay administrative costs of $216.58 and set a compliance deadline of April 11, 2025. If the estate fails to correct the violations by that date, the magistrate said a fine of $100 per day will be imposed until the property comes into compliance. The magistrate further noted that repeat violations would be classified as repeat violations and that a certified order may be recorded in the Brevard County public records.
City staff indicated people were observed living in the property; the magistrate said staff should be notified for reinspection upon compliance.
