The City Council approved Resolution R2025-04 authorizing the mayor to sign a franchise agreement with Cablevision Lightpath LLC to install fiber-optic infrastructure in the city’s right-of-way. Don Tingey, who presented the item, said the company reviewed the city’s template agreement and provided required materials for approval.
Tingey explained the installations typically run underground behind the curb or in park strips and follow the city’s encroachment-permit process and engineering requirements. He said franchise fees will be paid as the company provides services in the city. Council and staff noted the company’s proposed route runs approximately from 2700 West toward the Mountain View Corridor industrial area and will cross major arterials with appropriate state permits when required.
Tingey and staff said most private broadband companies bore underground in park strips and under roads rather than cut paved lanes, and that Google Fiber is a notable exception in the jurisdiction. He also referenced the Federal Telecommunications Act as constraining local authority over some aspects of broadband siting and competition.
Council Member (name on roll call) moved to approve Resolution R2025-04; the motion was seconded and approved by roll call vote. Council members Shelton, McGuire, Harris and Mayor Pro Tem Johnson each recorded “Yes.” The motion passed and the resolution was adopted.
No amendments were made during the discussion. Staff said the company will coordinate required encroachment permits and work with UDOT where the route crosses state roads; councilmembers encouraged the company and staff to complete crossings before planned state construction where feasible.
The resolution authorizes the mayor to sign the franchise agreement but does not itself obligate city capital funding. Staff said franchise fees paid by the company will be remitted to the city as customers take service.
