Monmouth City Council completed the second reading and adopted Ordinance 14-19 on illicit stormwater discharges and connections by a 5-0 roll-call vote.
Mark Bridal, Operations Manager in Public Works, summarized prior review of the draft ordinance, noting changes the council requested at a January 7 work session and the first reading on January 21. Bridal said attachment 2 contained the redline of the requested modifications and that the revisions had been incorporated into Monmouth City Code chapter 13.64.
Councilor Ridgeway asked a procedural question about how the city would respond if state or federal authorities later changed their model ordinance language or requirements. City Attorney Lane Sheverly replied: "It really does depend on what those changes would be. If there are changes that would create an inconsistency with the ordinance, we would need to amend the ordinance." Sheverly said model ordinance language is often provided and the city would evaluate any required amendments.
Councilor Kerrey moved adoption; Councilor McKeel seconded. Roll call: Ridgeway — aye; Oberst — yes; McKeel — yes; Lopez — aye; Kerrey — aye. Motion passed 5-0.
Ending: The ordinance copies model language from state and federal sources; staff and the city attorney will monitor regulatory changes and recommend ordinance amendments if needed.
