Board rescinds 2024 Title IX policy and reverts to 2020 rule framework after court decision

Following a Jan. 9 federal-district-court ruling that invalidated 2024 Title IX regulations, the Fond du Lac Board voted 6–1 to rescind local policy 2264 and return to the 2020 Title IX policy (2266) with limited edits.
The Fond du Lac Board of Education voted 6–1 to rescind Board Policy 2264 — which implemented the 2024 Title IX regulations — and to return to the district's prior Title IX framework aligned with the 2020 rule, with modest edits needed for compliance.
Marissa, the staff presenter, told the board the 2024 Title IX rule added provisions not present previously, including items the presentation characterized as "stereotypes... pregnancy and related conditions, and gender identity" that had been part of the 2024 rule. "The federal district court decision regarding those regulations determined that the entire thing is invalid. And so we are returning to the 2020 version of Title IX," Marissa said.
Board Member Henschel moved the resolution. During the roll call vote Board Member Godfrey recorded a "no" while six members voted yes; the motion carried 6–1. The administration said small adjustments to Policy 2266 are required to comply with the 2020 regulations.
The board did not debate specific complaint examples at length; the administration noted other policies addressing harassment and bullying remain in place.
