Senate committee rejects section of National Society of Genetic Counselors code in administrative rule

The Idaho Senate Health and Welfare Committee on the record approved a pending administrative docket and then voted to reject a subsection of the National Society of Genetic Counselors Code of Ethics that had been incorporated by reference into state administrative rules.
Committee business began with approval of pending docket number 24-2401-2401. Committee members then considered a motion to strike a portion of the NSGC Code of Ethics that had been incorporated into IDAPA rule language. Senator Bierke (mover) and a second were recorded for the motions. The committee voted by voice to remove that subsection; later a clerical correction was made to the motion language and the committee again voted to reject “section 2, subsection 3” of the NSGC Code of Ethics as incorporated by reference in IDAPA 24.24.01.002.
Chair remarks and committee discussion indicated the struck language was part of a broader body of standards the committee had reviewed. A committee member summarized the members’ concern as relating to nondiscrimination standards listed within that incorporated code, saying the item “had to do with, basically standards of nondiscrimination, and it listed out a long list of, people and identities that couldn't be discriminated against.” Committee members said the language had previously been discussed in committee and had drawn pushback in the House.
The committee conducted two recorded voice votes on the rule actions. After the second motion to reject the subsection, a senator recorded a “yes” on the roll call request. No further formal guidance or rescission of the committee’s ruling was recorded during the meeting.
The committee chair noted administrative-rule business was complete and staff would prepare the resolution paperwork and other follow-ups.
