The ordinance also includes an abandonment clause that allows code enforcement to notify a property owner and, if the owner fails to comply, permits the city to abate and assess the work to the property owner. Council members raised how financial responsibility for removal would be enforced if a company closed and left panels in place; staff pointed to the abandonment provision as the enforcement tool.
Council member Dale thanked staff for adding the disposal section. After a motion and second, the council voted to approve Ordinance 1417-25 on second reading; the mayor announced the motion carried.
The ordinance's new requirements become part of the city's site-plan review process under planning and zoning; the ordinance text requires a disposition plan to be submitted with the site plan and subjects abandoned systems to the city's abatement process. The council did not discuss an effective date in the meeting record.
