Wilmington New Hanover County Feb. 5, 2025 Planning staff outlined three proposed maintenance amendments to the county's Unified Development Ordinance (UDO) during the Feb. 5 Planning Board meeting and said the items are intended to keep local rules consistent with state law and correct housekeeping matters.
The three topics staff described were: removal of a local restriction that prevented the use of storage containers as a building material for accessory dwelling units to align with the North Carolina building code; changes to the ordinance to reflect revised state requirements and timelines for releasing performance bonds for development; and adjustments to sign rules to reflect a state law that allows replacement or relocation of nonconforming signs without requiring full compliance with a current ordinance. Staff said these are statutory or housekeeping changes and planned to present the amendments for public hearing at the March Planning Board meeting and then to the County Commissioners in April.
Planning staff emphasized that the proposed text changes respond to state statutory changes and technical corrections rather than new policy direction from the county. The board had no substantive questions and staff said they would bring formal text for public hearing and public comment in March.
No formal action was required at the Feb. 5 meeting; staff will return with draft ordinance language for the board's March public hearing and anticipated transmittal to the Board of Commissioners in April.
