Senate Committee on Government Operations advances multiple bills, defers several after Feb. 6 decision-making

The Senate Committee on Government Operations met Feb. 6, 2025, in Conference Room 225 for decision making on measures previously heard Jan. 30, advancing amended drafts for a number of procurement, personnel and government-records bills while deferring several others for further work or indefinitely.

Key changes and committee directions

SB 1091: The committee adopted a Senate Draft 1 that removes a standalone reference to OET (noting it now sits under the comptroller), adds a management-analyst position in DAGS’s Administrative Services Office to support the assessment, and narrows the assessment to Executive Branch departments and agencies occupying DAGS-managed facilities or nonstate facilities leased through DAGS. The committee also retained a consult provision with the Department of Human Resources Development (DHRD) and set the bill for further technical harmonization with an implementation date noted in the committee report.

SB 1057: The committee moved SB 1057 as a Senate Draft 1 with technical amendments and a defective-date provision. The draft clarifies that the bid incentive for public-works construction projects will be based on apprenticeable trades utilized in the project rather than trades merely employed to build it. SB 1065 (skills-based hiring): The committee passed an amended draft that prohibits requiring a bachelor’s degree as a condition of hire for many state positions while establishing exemptions. The measure passed with technical, non-substantive edits for clarity and consistency.

Procurement and construction measures: The committee advanced several procurement-related bills with amendments. SB 1175 (past-performance database) was advanced with a committee report appropriation for initial implementation costs and a one-time funding allocation noted in the report. SB 1587 (retainage) was advanced as a draft that adds a defined term “total project budget,” retains a cap and calendar-day limit placeholder for further study, and limits applicability to contracts executed after the statutory effective date specified by the committee. SB 1543 (government accountability) will adopt the state procurement officer’s suggested amendments and include language ensuring inherent governmental functions are not delegated to contractors.

Records and meetings

SB 1255 (government records/UIPA): The committee adopted a draft that narrows the measure to amendments to chapter 92F (UIPA) and clarifies that records used in the performance of a government function are government records subject to UIPA. The draft adds record-keeping and access requirements for contractors performing government functions and clarifies protection for proprietary contract information as not subject to UIPA disclosure.

Public meetings (SB 1651): The committee amended packet-distribution timing to require board packets to be distributed no later than 7:45 a.m. on the third business day before a meeting and removed repeated uses of the term “full” in the bill text; the measure was advanced for further committee consideration with an effective date to allow additional review.

Deferrals and study directions

The committee deferred several measures either indefinitely or to time certain for additional work. SB 444 was deferred indefinitely to allow interim work on complex issues raised in testimony. Brenna Hashimoto, director of the Department of Human Resources Development, described DHRD’s role as providing a telework framework and HR guidance to departments but said DHRD does not determine office-space allocations; that responsibility typically falls to DAGS and each department’s administrative-services office. Keith Regan, comptroller for the Department of Accounting and General Services (DAGS), stood on testimony in support of several administrative and procurement-related measures and answered committee questions about implementation and responsibility for space and procurement functions.
