Defense counsel Alfonso Cabanas told the court during closing that the officer’s testimony contradicted the stop narrative and that “at no point in time did my client commit any additional traffic offenses,” adding that Davis turned on hazard lights and sought a safe place to stop. The prosecutor countered that the officer had reasonable suspicion and cited Lopez v. State on the definition of fleeing, arguing the defendant’s conduct supported detention.
After the court reviewed State’s Exhibit 1 in full, the judge said, “After reviewing everything, listening to the testimony, and seeing states exhibit number 1, the court will find the defendant not guilty.” The court did not enter any sentencing or conditions since the verdict was acquittal.
The transcript shows the court accepted the parties’ closing arguments and relied on the recorded evidence in making the finding. Defense counsel thanked the court and the defendant was dismissed.
This ruling resolved the only contested matter in that docketed case without further penalty.
