The House Committee on Housing met Feb. 7 for a 9 a.m. public hearing and decision-making session and moved a number of housing bills forward while deferring others for further work.
The committee passed or recommended passage with amendments several measures that drew written or oral testimony from state agencies, nonprofit housing groups and local officials. Several bills were deferred for more study or because similar work is already underway elsewhere.
Votes at a glance
- HB1432 (listed in the hearing as HB 14 32): Recommended to pass as HD1 with technical amendments; committee report will show the appropriation; recommendation adopted.
- HB1428 (HB 14 28; housing counseling/HUD-certified financial education): Recommended to pass with amendments; the committee agreed to blank out the appropriation in the bill and reference the amount in the committee report; recommendation adopted.
- HB833 (community land trusts): Recommended to pass as HD1 with technical amendments, a defective date and an amendment to add Kohala Community Land Trust to the preamble; recommendation adopted.
- HB1009 (dwelling unit revolving fund / DERF): Recommended to pass with amendments adopting HHFDC-proposed changes, include a defective date; recommendation adopted.
- HB529 (state finances, revenue bonds): Recommended to pass as HD1 with clarifying language authorizing revenue bonds and to reference appropriation values in the committee report; recommendation adopted.
- HB432 (rental housing revolving fund / RHRF): Recommended to pass with amendments including defining ‘‘perpetual’’ as the life of the project and blanking out the appropriation for the report; recommendation adopted.
- HB419: Deferred.
- HB527 (prohibiting county legislative bodies from making cost-increasing modifications to projects): Deferred after testimony raised concerns about vagueness and unintended effects.
- HB416 (limits on county review of certain 201H projects): The committee debated narrowing the bill so only projects with a state financing commitment located in the urban state land use district could proceed without county legislative approval and gave the planning director the ability to reject permits within 30 days only for infrastructure reasons. During the vote the committee recorded a dissenting vote and the recommendation was reported as not adopted.
- HB417 (rental housing revolving fund subaccount use for for-sale housing): Recommended to pass with amendments that expressly prevent use for for-sale housing; the committee noted the issue should be revisited for future discussion; recommendation adopted.
- HB418 (qualified allocation plan working group): Deferred because HHFDC reported an active working group already exists.
- HB1411 (housing preference): Recommended to pass as HD1 with technical amendments; recommendation adopted.
- HB374 (updated housing preferences): Committee adopted AG suggestions to remove a durational residency preference and moved the bill with technical changes; recommendation adopted.
- HB373 (technical clarification preserving Act 45 amendments): Recommended to pass with amendments; recommendation adopted.
- HB1492 (affordable housing study / senate bill counterpart): Deferred pending further clarification from the Senate sponsors.
Why the decisions matter
Committee members said many of the bills would help finance or preserve affordable housing while others need more legal or administrative detail. The committee frequently adopted technical amendments asked for by the Hawaii Housing Finance and Development Corporation (HHFDC) and the Attorney General’s Office to reduce legal risk and improve drafting clarity.
What comes next
Bills that passed will be reported out of committee with the adopted HD1 language and the committee report will carry appropriation references where the committee chose to blank figures in the bill text. Deferred bills may be returned if sponsors refile or if Senate language is received clarifying intent.
The hearing record shows a robust mix of nonprofit, county and private-sector testimony and multiple technical changes requested by state agencies. The committee reconvened for decision-making immediately after the public hearing portion and adjourned following its votes and deferrals.
