The Board of Zoning Appeals approved a variance to allow a covered structure over an existing elevated deck at 401 Parker Court, permitting the homeowner to enclose and cover the portion of the deck that extends 4 feet into the required street setback.
Zoning staff said the parcel sits on a sloping lot and that a patio to grade would have been difficult; the deck was already constructed and the owner sought permission to install a roof over it. Appellant Santia Kennan told the board that the deck was installed as part of the new‑build elevation to allow access from grade and described a final certificate of occupancy previously issued for the home. Kennan said she applied for a permit to cover the deck only after moving in and being told the deck itself lacked a covering permit.
Board members noted the slope of the property and the functional difficulty of providing a patio at grade and concluded the narrow, four‑foot encroachment into the setback met the variance standards. A motion to approve the variance carried 4‑0.
The board’s approval applies only to the limited encroachment necessary to cover the existing deck; any future work beyond that scope will require separate permits and compliance with zoning and building codes.
