During its Jan. 22 meeting the Planning Commission reviewed four family‑conveyance/minor subdivision items on private roads.
Usher Subdivision (MSUB 06‑11000027): Staff reported the applicant met the criteria for an additional family conveyance lot on Usher Lane, and a new road‑maintenance agreement had been signed and recorded for the users of the private road. Staff found no outstanding issues and recommended approval. Commissioner Evans moved to approve the family conveyance, with the condition that agreements ensuring access, use and maintenance of the private road be recorded prior to plat recordation; the commission approved the motion (seconded by Commissioner Hayden).
Land of David Larson (MSUB 06‑11000096): The commission approved the family conveyance for an additional lot on Richey Road (private section), subject to recording of a road‑maintenance agreement. The applicant and neighbors stated they would sign the agreement; the commission approved the plan on a motion by Commissioner Chase, seconded by Commissioner Squazo.
Two other minor‑subdivision/family‑conveyance items (Wayland subdivision and Watson minor resubdivision) were not acted on at the meeting after staff and the county attorney identified defects in mailed notices for some affected properties and one case needed republishing/renotification. The county attorney advised republishing and returning the items to a later meeting so affected owners have proper notice. Commissioners agreed and scheduled the items to be renotified and placed on a future agenda.
For approved family conveyances the commission required that road‑maintenance agreements be recorded and that any missing signatures be obtained prior to plat recordation.
