The St. Mary's County Planning Commission on April 23 voted unanimously to recommend that the Board of County Commissioners adopt amendments to Schedule 32.1 of the county's comprehensive zoning ordinance. The motion authorized the planning commission chair to sign a resolution conveying the recommendation.
In a motion read into the record, a commissioner moved to amend schedule 32.1 to delete the existing footnote 7 and insert a new footnote 7 applying a 40-foot height limit to the RPD, RSC, RCL, RL, RNC, RMX, BMX and TMX zones with clarified language that existing buildings constructed as of the effective date of the amendment are not to be treated as nonconforming building heights. The commission also proposed adding a new footnote 12 to address site-by-site analyses for compliance with chapter 43 AQ and AE height restrictions and to require improved sprinkler systems for structures over 45 feet. The motion further specified that communication towers are exempt from Schedule 32 height restrictions and are regulated by Chapter 51 of the ordinance, and it directed correction of a spelling error at footnote 10.
Mister Thompson made the motion; Mister Chase seconded it. The commission voted "Aye" with no opposition.
The changes are intended to correct errors and clarify how the county's height rules apply across zoning categories, and staff was authorized to prepare a resolution for the Board of County Commissioners conveying the recommendation.
