Planning commission approves family conveyance to add one lot in Schumacher Subdivision

St. Mary's County Planning Commission approved a family-conveyance minor subdivision on Aug. 25 that will add one lot to the Schumacher Subdivision (M Sub. No. 07-11000086), a 14.24-acre property owned by Joseph and Rosalie North.
Under the family-conveyance provision of the county subdivision ordinance (section 30.11.4), the commission approved creation of a lot limited to conveyance to a family member. Staff from the Department of Land Use and Growth Management recommended approval after technical review; David Berry, a department representative, told the commission the applicant agreed to the ordinance’s required covenants and conditions.
The plan would increase the number of lots served by the private section of Camp Casoma Road to six. Staff reported Camp Casoma Road is shown as a 30-foot right-of-way and described a tar-and-chip driving surface 18 to 20 feet wide. Because the portion providing access to the proposed lot is maintained by the state of Maryland, staff said no separate private road maintenance agreement was required; the motion as approved requires that agreements ensuring continued access, use and maintenance be recorded only if needed prior to plat recordation.
The approval includes several ordinance-mandated conditions: the grantee must be a family member of record as defined in section 30.11.4; a family conveyance agreement restricting transfer to third parties for five years (except for hardship as determined by the director of Land Use and Growth Management) must be recorded; and the family-conveyance restrictions must be noted on the subdivision plat. Commissioners also required that any necessary reserve density be documented on the plat before recordation.
Commissioner Hayden moved approval after accepting the staff report and findings under section 30.11.4; Commissioner Chase seconded. The chair called for the question and the motion passed unanimously.
The commission’s approval is preliminary; staff will verify mailed notices to private-road users and contiguous owners and ensure the required recordation and covenant language are completed before plat recordation.
