Chattanooga Beer Board approves Jan. 16 minutes, outlines process for new administrative hearing officer

The meeting included a staff report that two beer-license-related applications were approved administratively by regulatory staff: Food Truck Festivals of America LLC (listed as T-EDash67 in the staff report) and Kwik Trip Corporation (listed as beer 1304). Staff told the board there were no temporary beer applications on the agenda and no additional beer applications requiring board action.
Board discussion focused on the new process for handling citations. Madam Chair explained the procedure: "The way our new system works is when there are violations written by CPD, then the violation will come before the administrative hearing officer. He will hear the case and then he will make a determination." A separate speaker clarified the hearing officer will make a recommendation for a finding and a punishment, and the board will vote to either ratify that recommendation or impose a different outcome.
Board members were told the administrative hearing will take place after the board adjourns and that, when an appeal to the Beer Board occurs, the matter will be scheduled at the board's next regularly scheduled meeting. Madam Chair encouraged members to observe the new hearing process: "...I would encourage the board members to sit in the audience and let's observe this because this is the first 1 that will be taking place by the administrative hearing officer so we will have a better idea of what's happened before it gets to us on appeal." Staff member Laurie was asked to swear in any individuals who would testify in the hearing.
There was no public comment recorded during the meeting. The board moved to adjourn the regular meeting so the administrative hearing could proceed; the motion carried on a voice vote. The administrative hearing was scheduled to begin immediately after a brief recess.
