Commission finds Mead County registrar liable for misuse of public resources, orders fine reduced if paid promptly

The Kansas Governmental Ethics Commission found Irma Alaniz liable on Jan. 22 for using public county equipment to produce campaign materials and assessed a civil fine.

Staff presented a sworn proffer and attached documents showing that Alaniz, the Mead County register of deeds and a candidate in the 2024 election cycle, used the county’s copier and printer to reproduce campaign flyers bearing express advocacy language (the flyers stated "reelect Irma Alaniz"), a use staff said is prohibited under the Campaign Finance Act. Counsel for the commission explained the statutory prohibition: government employees may not use government supplies or equipment for material that expressly advocates the nomination, election or defeat of a clearly identified candidate (KSA 25‑41‑69).

Alaniz did not appear at the hearing; staff said the respondent returned a signed receipt for certified mail but did not participate in the proceedings after earlier communications. The commission moved to find Alaniz liable based on the sworn statements and documentary evidence in the record.

Commissioners then considered an appropriate civil penalty. Staff recommended a range between $500 and $1,000 based on prior precedent for similar misuse of public resources; commissioners approved a fine of $750, with a concession that the amount would be reduced to $200 if paid within 30 days. The commission also authorized its hearing officer to prepare the written order reflecting the finding and penalty.

The commission made the finding and levy by voice vote at the meeting; staff will make the order available and begin the process for collection or enforcement if the respondent does not pay within the reduction window.
