Planning commission approves vacation of pooling easement at future Lawn King site

The Grand Forks Planning & Zoning Commission unanimously approved a request on Feb. 5 to vacate a 12.25-acre pooling easement at 2500–2600 North Washington to allow a new easement to be recorded in a location that matches the site’s updated floodplain map.
Planning staff explained the existing easement, shown on the record exhibit as cross-shaded, covers most of the Lawn King development parcel except three residual areas and was established after the 1997 flood and construction of the city’s flood-protection system. Miss Johnson, planning staff, told the commission the site received a Letter of Map Revision as part of a December 2024 replat and rezoning, and that the change will cause pooling to occur in different locations than the existing easement anticipates.
Miss Johnson said the U.S. Army Corps of Engineers has reviewed and approved the updated arrangement and will draft the new easement for filing; staff recommended approval of the vacation so the Corps can record an easement that aligns with the LOMR. Commissioner Budke asked whether the new easement document would return to the commission; staff replied the Corps will draft and the new easement can be filed with the county without a separate P&Z action.
No members of the public spoke during the hearing. Commissioner Eichert moved approval; Commissioner Mattson seconded. The commission voted unanimously to approve the vacation.
The action vacates only the existing pooling easement; the Corps will prepare and file a new easement that staff said will dedicate the updated pooling area consistent with the revised floodplain mapping.
