The court continued a Feb. 5 readiness hearing for defendant Pablo Alvarez Cota after prosecutors reported repeated unsuccessful attempts to interview an alleged victim and asked the court to permit a deposition and continuance.
Allison Oster, a court-certified Spanish interpreter, appeared for Alvarez Cota, who was present on Zoom but lacked a working camera. Defense counsel and the prosecutor told the court the city had attempted to secure a voluntary interview with the alleged victim without success. Defense counsel agreed to waive speedy-trial time for the continuance.
The judge directed counsel to prepare a proposed order documenting attempts to contact the alleged victim and to coordinate with the prosecutor to schedule a deposition date when the prosecutor can attend. The judge said the court could issue a subpoena ordering the alleged victim to appear for deposition and indicated a material-witness warrant could be considered if the witness defied a court order to appear, although the judge did not commit in advance to issuing such a warrant.
The court set a readiness date for April 2 at 2 p.m. and scheduled a trial for April 8 at 9 a.m. on the interpreter calendar; parties agreed the speedy-trial clock would commence March 19, with an approximate speedy deadline around June 17. The judge instructed parties to resolve the interview scheduling off the record by written request and said notice would be mailed to Alvarez Cota.
