Daytona Beach Shores approves outdoor-dining conditional use permit for Mulligan’s Lagoon

The Daytona Beach Shores City Commission voted 5-0 to approve a conditional use permit allowing outdoor dining at Mulligan’s Lagoon, 2504 South Atlantic, permitting six outdoor tables, a counter and 38 chairs.
City planner Ed Wen Herstein presented the application and told the commission the site is in the GCRD zoning district and that Planning & Zoning had recommended approval. “All five [conditional use] criteria were met for this particular application,” Wen Herstein said, and he noted that of 18 additional site-specific criteria, 17 applied and were met while one did not apply.
The applicant, one of the owners David M. Bailey, and the mini-golf general manager, Ike Hoch, were present for questions. Staff materials and site photos submitted with the application showed the layout; Wen Herstein noted the applicant’s plan originally pictured 10 bar stools but that only eight would be used. The presentation said public notice requirements and staff review were completed and that the permit location is on the southeast corner of the property as shown in the applicant exhibits.
During the quasi-judicial hearing, the commission asked whether any commissioners had ex parte contact; a few members said they had visited the site as patrons or inspected the proposed area. A nearby resident, Valerie McClain, spoke after being sworn and told the commission she lives on Dundee Road and supported the business. “It’s a wonderful addition to the street… it attracts families,” McClain said, adding the site is well kept and staffed.
A motion to approve the conditional use permit was made and seconded; after the quasi-judicial opportunity for public comment and a roll call, the permit passed 5-0. The Planning & Zoning Board had recommended approval at its Jan. 13 meeting and staff recommended approval in its report.
The permit authorizes outdoor dining at the specified location; no specific implementation timeline or conditions beyond those in the staff report were stated during the hearing.
