Senate Bill 761, which extends the required return date for motions for judgment or warrants in debt from 60 to 90 days, was reported out of the Veil Law Subcommittee on a recorded roll of 8-0.
Senator Sturmick presented the bill, saying the change addresses scheduling problems in smaller general district courts that do not sit frequently and have limited docket slots. "By adding this additional 30 days, that'll free up some time in our clerks," Sturmick said, noting the change was supported by the Virginia Trial Lawyers Association (VTLA).
Subcommittee members said the problem also appears in larger jurisdictions. Delegate Elliot Ballard noted long dockets in areas with populations over 250,000. Matt Benedetti signaled support for the bill during the hearing.
A motion to report the bill was made, seconded and the clerk opened and closed the roll; the clerk announced the bill "reports 8 to 0." The bill will proceed from the subcommittee to subsequent committee consideration.
