Council approves first-reading ordinance to abandon portion of Cody Drive right-of-way
Summary

On Feb. 3 the Tomball City Council adopted on first reading Ordinance No. 2025-03 to abandon one-half of a 30-foot Cody Drive right-of-way (about 0.1032 acres) adjacent to a proposed development. Staff said the conveyance would be by quitclaim deed to the requesting adjacent owner and that a public-utility easement would be retained to protect an existing sanitary sewer line.
Staff explained the abandonment is not tied legally to the conditional-use permit discussion earlier in the meeting although the applicant has noted the abandoned right-of-way could provide additional area for maneuvering and circulation if the CUP moves forward. Council members discussed the geometry and existing pavement in the area and asked staff to verify historic abandonments and existing title records; staff noted some early records are difficult to interpret and that easements will remain for utilities.
The motion to adopt Ordinance No. 2025-03 on first reading passed unanimously.
