The Forward Conservation Commission voted on Feb. 3 to send formal 60-day notice letters to five property owners with outstanding enforcement orders that have not produced a satisfactory response.
Conservation staff presented a list of sites with outstanding enforcement: 101 Hayfield Lane; 2089 Blossom Road; the North Main Street/Weaver's Cove/National Grid site; the property on Bart and Bronson Street; and 221 Fieldstone. Staff reported varying levels of engagement: some sites have consultants and draft plans in progress, while others have had little or no response in months or years. The commission discussed that one homeowner at Blossom Road has a language barrier and recommended bilingual notification.
Commissioners directed staff to prepare a standardized letter giving each respondent 60 days to file a substantive restoration or compliance plan. The letter will state that, absent a substantive filing, staff will seek departmental action from the Massachusetts Department of Environmental Protection (MassDEP) and may pursue legal remedies through the city's attorney. Commissioners said the step is intended to create a paper trail documenting persistent noncompliance.
A motion to send the 60-day letters and warn of possible DEP referral and legal action passed by roll call.
Staff said they would send the letters within the week, translate messages where necessary and include all listed properties in the outreach.
