Committee approves technical recodification separating private postsecondary education from public code

The House Education Standing Committee approved a first substitute to HB 341, legislative cleanup that separates and clarifies statutory references to private postsecondary institutions from public higher‑education law.
Representative Peterson described the measure as a recodification effort to create a clear statutory definition for “private postsecondary education” and to move private postsecondary references into a distinct part of state code. Eric Davis, university counsel for Brigham Young University, testified in support of the approach and told the committee BYU supports clarifying the distinct regulatory treatment of public and private institutions.
The first substitute was adopted and the committee issued a favorable recommendation to the House. Lawmakers said the change is technical and intended to ease future drafting, rulemaking and compliance work by avoiding mixed references to public and private postsecondary entities in a single code section.
