The commission held a public hearing and received comments about a proposed reapproval of a planned residential development overlay (Ashley Grove) on a roughly 5‑acre parcel at 2623 Center Avenue.
Staff explained the planned residential development overlay requires a site development plan within prescribed timeframes; the petitioner did not submit a timely site plan and the single allowable extension expired. Under the overlay rules, the department presented the required notice to consider reversion of the property to the NU (Non‑Urban Residence) district and the potential termination of the overlay.
Several nearby residents, including Jean Capitara of Balestone, said a previously approved configuration (12 lots including the existing dwelling) was acceptable and that the community had been prepared to accept that plan. Capitara expressed specific concerns about a proposed gated emergency turnaround and predicted the developer seeks additional lots for profit. The resident requested the commission “stick to your guns” and reapprove the plan that had been acceptable to neighbors two and a half years earlier.
Commissioners and staff clarified that because the site development plan was never formally submitted and the extension period lapsed, the prior preliminary plan cannot be enforced as an entitlement. Director Vinich said staff expects to prepare a report that will support retention of the overlay and reestablishment of the conditions before the commission at a future meeting; if the commission reverts the zoning to NU, the petitioner would need to start a full new application.
Clarifying details: site approx. 5 acres in Ward 8; proposal discussed previously showed 12 lots inclusive of the existing home; overlay rules allowed one extension plus 6 months which expired; staff plans to prepare a report and recommendation for the commission’s next meeting.
What’s next: Department will prepare a formal report with recommended action for the Planning and Zoning Commission; no final decision was taken at the hearing and the matter will return as an action item for the commission.
