Tinley Park board approves first reading for front-yard deck variation despite Plan Commission denial

The Tinley Park Board of Trustees on Feb. 4 granted a first reading of Ordinance 2025-0-003, which would allow a variation from the zoning ordinance to permit a deck within a required front yard at the property identified in the staff report (transcript lists as “7542160 Third Place”). The Plan Commission held a public hearing on Jan. 16, 2025 and voted 1–4 to recommend denial; the board voted 6–0 on first reading to approve the ordinance and scheduled a second reading for Feb. 18.
Trustees debated the request at length. Several trustees said the proposed deck/porch would modernize the house, enhance neighborhood character and present no public-safety concerns. Trustee Mahoney and Trustee Mueller described the change as an aesthetic improvement that would not impair light, air or street congestion. Multiple trustees expressed sympathy that the homeowner reported being misled by a contractor; several urged stronger efforts to hold contractors accountable and suggested proactive code- and outreach changes to prevent similar problems.
Trustees also acknowledged the Plan Commission’s role. Trustee Shaw and others said the Plan Commission followed the existing ordinance in recommending denial; several trustees said they support updating the zoning code to reduce the need for variance petitions in that neighborhood. Staff said the variation relates to section 3-3.H.1 of the zoning ordinance and that a zoning-code rewrite guided by the village’s forthcoming comprehensive plan would be considered as a future project.
A petitioner or homeowner addressed the board and asked for the board’s support to keep the addition in place, saying the family intended to remain in the home and valued neighborhood ties.
The motion to approve first reading passed by roll call 6–0. Because there was at least one no vote during Plan Commission review, the board cannot waive first reading and will resume the item for second reading on Feb. 18 as required by the village’s ordinance procedures.
The board discussed follow-up actions including a potential zoning-code rewrite to clarify porches vs. decks and improved permit/inspection notifications to homeowners through the village’s new ERP system.
