Representative Jaren Crane (District 12, Nampa) said RS32035 is a targeted "cleanup" to Idaho's riot statute, which lists physical injury, property damage and disturbance of the peace as elements of a riot but currently assigns penalties only for property damage and disturbance of the peace. Crane explained the draft adds the same penalty for causing physical injury in the course of a riot so prosecutors can assign a statutory penalty under the riot code.
When asked if physical injury was already a crime outside the riot statute, Crane said assault and related offenses remain crimes but that, in the context of prosecuting a riot, the statutory framework currently lacked a clear penalty for the physical injury element. Representative Gannon moved to introduce RS32035 and the committee approved introduction by voice vote; the sponsor said the measure simply fills a gap so penalties are available when a riot involves bodily harm.
