Legislative counsel presented draft 1.1 of a special report to the House Government Operations & Military Affairs committee on Wednesday that recommends the House affirm the certified results in the contested election for House District Bennington 1 and describes the operative language commonly used in prior contested-seat reports.
Tucker Anderson, legislative counsel, read the two-paragraph draft and told the committee, “You should have in front of you draft 1.1 of the committee's special report on the request of Bruce Busa for the House to judge the election and qualification of member in House District Bennington 1.” The draft follows the structure the counsel said has been used in past special reports addressing contested elections.
The draft includes two operative clauses: that the committee considered the request that the House judge the election and qualification of the member for House District Bennington 1, and language affirming the certified election results and stating the committee’s finding about the member’s election status. Committee members confirmed they requested the phrase “certified election results” be included because this contest involved a certified outcome.
Members spent much of the discussion on whether to add a brief, journalized statement explaining the committee’s reasoning and process for future legislatures. Several representatives said archived video and digital records make testimony easier to review, but journalizing a concise explanatory statement would provide a single, searchable summary for future committees. A member noted that a journalized statement would represent the body’s consensus and could be used as evidence in later proceedings.
No final vote occurred during the discussion. Committee members agreed to reconvene and vote on the draft at 10:55 a.m. Members were asked to submit any language suggestions before that time.
