Board approves rear-yard fence variance for 56 Shady Oak Drive

The Mobile City Board of Adjustment on Feb. 3 approved a variance that lets a new single-family home at 56 Shady Oak Drive place an 8-foot privacy fence near the rear property line.
Brian Maisel, the applicant, told the board the lot uniquely fronts a service road behind the houses and that a stormwater drainage canal and natural brush prevent practical access from the rear. He said the requested fence location matches a variance the board granted last year for a lot two doors away. "Last year the Board of Adjustment unanimously voted to approve this variance to allow me to have a backyard at this property and to put the fence, 8 foot fence, in the backyard within that, the edge of the setback," Maisel said.
Board members had no public opposition and staff confirmed no public commenters at the hearing. After a short deliberation the board moved and approved the variance; the chair called for the ayes and announced the motion carried.
The approval repeats relief previously granted nearby and is intended to allow a usable backyard for new construction in the neighborhood while maintaining an 8-foot screen at the back of the lot. No additional conditions, permits or enforcement actions were recorded in the meeting minutes for this application.
The board concluded the public hearing on the item and moved on to the next application.
