John Suarez, the town code inspector, summarized the case file and stated the property was initially cited June 12, 2023 for work without permit and related permitting violations. The magistrate recited the hearing history: an initial finding of violation and previous compliance deadlines and continuances, most recently to Jan. 10, 2025. Suarez said the owner resubmitted corrective plans on Jan. 22, 2025 and that the town needs time to review and approve permits; the town did not object to another continuance.
The magistrate admitted the town’s evidentiary case file and, noting the respondent was not present at the hearing, found service sufficient. The magistrate maintained the previously established daily fine of $250 in the event of noncompliance and reserved administrative costs for the hearing. The magistrate set appearance at the April 7 fine-assessment hearing if the property remains noncompliant.
