City staff said utilities—sewer and water mains—have long run through the property but no recorded recorded easement exists; staff described the pipe in that backyard as an older 4‑inch main susceptible to deterioration and noted the city has repaired nearby leaks in the past. Staff also noted a locate had been requested and utility lines were marked before construction activity, but there is disagreement about whether the homeowner exceeded permitted deck dimensions during construction.
Board members expressed concern about liability and emergency operations should the city need to excavate a failing main that lies under or near an attached deck. Board member comments asked whether the city would remove the deck in an emergency, who would bear the cost, and whether removing a deck attached to a house could create damage and additional liability. Legal staff warned possible litigation if the city insisted on dismantling a deck where a permit or written approval may exist.
Craig Phillips, planning, recommended tabling the matter so planning, engineering and legal staff (including Nick Otis) could review building permits, any use or development variances and locate/record evidence. The board voted to table the item and asked staff to return with a complete record before taking formal action.
No enforcement action or removal was ordered at the meeting; the board’s vote was to postpone a decision pending staff compilation of the permit, variance and locate history.
