The Oviedo City Council on Feb. 3 directed staff to prepare an ordinance to amend the city’s smoke regulations (Code Sec. 22‑147) to reflect the consolidated industrial zoning district and to retain stricter opacity limits near residential areas.
Staff explanation: Brian Cobb explained the city’s land‑use rewrite consolidated the former I‑1 and I‑2 industrial districts into a single industrial zone. The proposed code change removes the old dual paragraphs and inserts a single provision that keeps the most restrictive elements of the prior rules. Under the recommended language an industrial use may not exceed a Ringleman 1 opacity baseline; limited temporary exceedances to Ringleman 2 would be allowed for up to four minutes in an eight‑hour period provided the source is at least 500 feet from a residential district. Cobb also noted a Scrivener’s correction to the spelling of “Ringleman.”
Council direction: Councilmembers asked whether the changes would affect existing operations; staff said the amendment is an environmental regulation not a property‑use taking and would not create a land‑use taking. Following discussion the council instructed staff to prepare an ordinance for formal introduction and public hearing.
