The Jacksonville Beach Board of Adjustments granted Saltair Homes a variance to allow 43% lot coverage — above the city—s 35% limit — for property at 419 Fifth Avenue North, Lot 9. The board approved BOA-24-100090 by a 4-1 roll-call vote after hearing from the applicant; one resident addressed the board during the public hearing.
Applicant Oliver Kraut, who said he lives at 226 Tallwood Road, again told the board his hardship is a nonconforming lot width and that the proposed house would be consistent with surrounding construction. "My hardship is that I have a nonconforming lot in width, and I think it would be consistent with the other homes in the neighborhood," Kraut said.
A private citizen, Bruce Paul Wouders of 126 Twelfth Avenue South, spoke during the public hearing and provided a measurement he said applies to the lot: "50 times 125 to 6,250 square feet," Wouders said, referring to lot dimensions. No other public commenters registered.
Board members discussed whether the requested coverage met the code—s minimum-variance requirement, noting that the lot size exceeds the minimum area in the city code even if the width is substandard. After debate, the board took a roll-call vote: Jennifer Williams, yes; Matt Metz, no; John Moreland, yes; Douglas Dell, yes; Owen Curley, yes. The chair announced the variance approved.
The board cited section 34-2-86 of the Jacksonville Beach Land Development Code in applying the variance standard. The approval pertains only to BOA-24-100090 and does not alter other code provisions or future permitting reviews.
