The Zoning Board of Adjustment on Jan. 27 approved a special exception K to legalize an existing encroachment of 1 foot, 7 inches into the five‑foot side‑yard setback at 552 Martha Way, representing 78 square feet of encroachment.
Blanca Perez of Planning and Inspections told the board the property is in an R3 residential zone and presented aerial photos, a site plan and a 2008 image showing the encroachment existed previously. Notices were mailed to property owners within 300 feet on Jan. 16, 2025; staff reported no communications in support or opposition. Perez recommended approval to legalize the existing structure.
The applicants, Rebecca and Jaime Lopez, appeared and told the board they agreed with staff’s recommendation. Martha Guayo moved to approve per staff recommendation and Christine Loveridge seconded; the chair announced the motion passed and the item was recorded as approved.
Planning staff will document the approval and proceed with any necessary permitting or record updates to legalize the existing structure.
