The Zoning Board of Adjustment on Jan. 27 approved special exceptions for an existing single‑family home and a proposed porch at 915 Kelly Way, allowing multiple encroachments into front, side and rear setbacks based on the lot’s nonconforming status and the property’s age.
Blanca Perez, Planning and Inspections, said the property is in an R3 zone and that the applicant requested Special Exception B (nonconforming lots) and Special Exception K (existence 15 years or more). Based on the presentation, staff said the approvals would allow an encroachment of 2 inches into the front‑yard setback, 5 feet into the side yard, and 30 feet into the rear yard, and would legalize the proposed porch encroachment. Aerial images, staff said, showed two other properties in the same block — 825 Galloway and 714 Winter Drive — with similar rear‑yard encroachments.
Notices were mailed to property owners within 300 feet on Jan. 17, 2025; staff reported one phone call in support. The applicant, Thomas Norris, spoke briefly and offered no objections. Janet Fortune moved to approve the special exceptions; the motion was seconded and the chair announced the motion passed.
Staff recommended approval and the board granted the exceptions, allowing the existing encroachments to remain and the proposed porch to be built as described in the site plan. The board did not record an on‑the‑record roll‑call tally for this item.
