The West Allis Public Safety Committee recommended a minimum 10-day suspension of license ALC 2323 after finding the allegations in the complaint to be true and that the licensee admitted the violations.
City Attorney Nicholas Serwin told the committee that the complaint had been properly served and said, “The allegations … were found to be true. The licensee admitted to those violations of the complaint.” He added that the panel was recommending “the implementation of the minimum 10 day suspension of the license, ALC 2323.”
Serwin told the committee the suspension “will begin on February 12th at 9 o’clock a.m.” and will run consecutively, with the licenseholder eligible to resume operations at 9 a.m. on Feb. 22. He described the penalty as the minimum called for under statute, saying, “This is the statutory, the very minimum penalty you get.”
The Public Safety Committee’s recommendation will be considered by the West Allis Common Council on Feb. 11, where council members are expected to vote on whether to adopt the suspension. Serwin said the council meeting would be the anticipated approval step and noted there may not be time for argument at that meeting, though the licensee may make a public comment.
Committee members also warned the licensee that further violations could trigger progressively larger penalties under the local enforcement framework described at the meeting.
After the committee concluded its recommendation on ALC 2323, members moved to adjourn; the motion was seconded and the committee voted verbally to adjourn.
