Bill introduced to affirm providers' statutory authority to deliver Medicaid services

Representative Jordan Redmond (District 3, Kootenai County) said RS32089 would clarify that Medicaid cannot restrict practice authority that the Legislature and licensing boards have granted to providers.
"RS 3,2,0,8,9, is a bill that clarifies the statute that Medicaid will not limit practices authority conferred by the register legislature and licensing boards," Redmond said, adding that "any service covered by Medicaid can be provided by any legislatively authorized provider who completes the Medicaid provider agreement." He characterized the bill as restoring authority to the Legislature rather than leaving it to administrators.
Redmond told the committee that a recent audit by the Idaho Department of Health and Welfare had, in his view, shown confusion within the department about the scope of legislatively granted practice authorities; he said the bill would "put the authority back in the legislature's hands where it belongs and not with state and federal bureaucrats."
Representative Kaler moved to introduce RS32089; the motion passed by voice vote and the RS was introduced. Committee members asked the sponsor to provide concrete examples and additional detail at a full hearing to clarify which providers and services the bill would affect.
No amendments were offered at introduction.
