House Health and Welfare committee approves multiple professional licensing rule changes; rejects pharmacy temporary rule

The House Health and Welfare Committee considered and acted on a series of pending and temporary rule dockets affecting multiple health professions, rejecting one temporary pharmacy rule chapter and approving several other rule packages and rewrites from occupational licensing boards and advisory committees.

The committee rejected docket 24-3601-2401 (Board of Pharmacy temporary rule chapter) after the Board’s executive officer asked the committee to take no action so the temporary rules would expire; Representative Redmond moved to reject that temporary rule chapter and the motion carried.

The committee then reviewed and approved a comprehensive rewrite of the Idaho State Board of Pharmacy rules (docket 24-3601-2402) that the board presented as a “ZBR” (zero-based regulation) chapter rewrite. Nikki Chopsky, bureau chief for the Health Professions Bureau, said the board made more than 35 changes to simplify or relocate duplicated statutory language and to move some items to statute following passage of House Bill 527. The committee approved the pharmacy rewrite but excepted new rule 200.14.e.12; the committee recorded approval by voice vote.

The committee also approved a combined rewrite for the Board of Medicine (docket 24-3301-2401) that consolidated two chapters into a single chapter and repealed an older chapter; the board incorporated changes tied to recent legislation including provisional and limited licenses for international physicians (House Bill 542) and provisions for Bridgier physicians (House Bill 153).

A slate of allied-health dockets presented by program directors Oren Duffin and Warren Duffin was approved: athletic trainers (docket 24-3305-2401), respiratory therapists (24-3306-2401), dietitians (24-3307-2401), and naturopathic medical doctors (24-3304-2401). The allied-health rewrite process followed last session’s House Bill 436, which merged several small profession boards into a single Allied Health Advisory Board. Presenters said the rule changes primarily removed duplicative language, consolidated fee tables, and struck inactive renewal fees that were inconsistent with Idaho Code 67-2614.

The Idaho State Board of Chiropractic Physicians’ ZBR rewrite (docket 24-0301-2401) was approved. Presenter John Price highlighted changes that reorganized definitions, moved fees, clarified permitted roles for chiropractic assistants, and removed duplicative statutory prohibitions on sale or compounding of certain prescription products.

Why it matters: The committee’s actions implement multi-agency efforts to streamline rule chapters, remove duplicative language that mirrors statute, and align fee schedules and continuing-education cycles across professions. Several dockets explicitly referenced recent legislation (House Bills 527, 505, 542, 153 and 436) and reflected administrative efforts to move enforceable items into statute or a clearer rule structure.

Votes at a glance: The committee rejected docket 24-3601-2401 (Board of Pharmacy temporary rules) by motion made on the record; it approved docket 24-3601-2402 (pharmacy ZBR) with exception of new rule 200.14.e.12; it approved the Board of Medicine dockets and all allied-health dockets listed above and approved the chiropractic rewrite. Most approvals were by voice vote; where roll calls occurred the transcript records the outcome or names of members recorded.
