DEQ revises low-level radioactive materials disposal chapter to reduce regulatory burden, update references

The Department of Environmental Quality presented a rule docket to revise the chapter governing disposal options for certain low-level radioactive materials (IDAPA 5-801-110). Michael McCurdy, Waste Management and Remediation Division Administrator, told the committee the rulemaking implements a 0-based regulation review to reduce regulatory text, streamline provisions and improve clarity.
McCurdy said the rule reduces the number of incorporated-by-reference federal citations — for example, standards for protection against radiation and definitions of unimportant quantities of source material — and revises several definitions (such as byproduct material, licensee, naturally occurring radioactive material (NORM) and technologically enhanced NORM). He said some provisions that referred to licensed facilities not regulated by this chapter were removed and that DEQ clarified records and disposal-record examples.
Public notice appeared in the Aug. 7, 2024 Idaho Administrative Bulletin; McCurdy said no written public comments were received and that the Board adopted the pending rule Nov. 14, 2024. DEQ recommended committee approval at a later vote; the committee did not vote during the hearing.
