DEQ updates hazardous-waste rules by incorporating federal changes; no written public comments

The Department of Environmental Quality presented rule docket IDAPA 5-801-105, an annual incorporation-by-reference package to align Idaho hazardous-waste rules with federal regulations through July 1, 2024.
"This rule incorporates federal regulations with a July 1, 2024 effective date," Waste Management and Remediation Division Administrator Michael McCurdy told the committee. He said the incorporation includes an update to EPA Method 23 (an analytical method) and technical corrections or clarifications to existing federal rules such as the hazardous waste generator improvement rule, the hazardous waste pharmaceutical rule, and the definition of solid waste.
McCurdy told members that incorporating federal regulations maintains state program primacy and simplifies compliance by providing a single set of rules for regulated facilities. He said public notice was published in the Aug. 7, 2024 Idaho Administrative Bulletin and that no written comments were received; the Board of Environmental Quality adopted the pending rule Nov. 14, 2024.
DEQ recommended the committee approve the pending rule at a later vote; the committee did not take a vote during this hearing.
