Committee introduces RS to clarify volunteer rules for retiring public employees

An RS (listed as RS 31989 in the meeting) was introduced to clarify when a retiring employee may serve as a "bona fide volunteer" without creating disqualifying employment that could threaten retirement benefits.

The sponsor said the language is aimed at common situations in which retired professionals — teachers, law enforcement officers and firefighters were cited as examples — want to offer advice or occasional assistance without replacing a paid position or receiving compensation. The sponsor described the proposed definition: a bona fide volunteer "means an individual who performs service without promise, expectation, or receipt of any type of compensation" and who is not performing work that would normally be compensated by the employer. The presenter said the RS is intended to reduce administrative burden for the retirement system (referred to during the meeting as "Percy") and avoid investigations triggered by nuisance complaints that could imperil benefits.

The sponsor credited Michael Hampton with assisting in drafting the language and stressed that the RS does not authorize paid work or change compensation; it is a narrow definition intended to preserve benefits while allowing occasional, uncompensated volunteer assistance from retirees.

The committee approved introduction of the RS by motion and voice vote; the RS will proceed to public hearing where the retirement system, employer groups, and employee representatives can offer technical feedback and propose adjustments.
